Abstract

The economic analysis of legal institutions has gained considerable importance in recent years. Indeed, the main objective of this work focuses on the study of the economic analysis of the monetary irregular-deposit contract by three different methodological approaches. Chapter 1 analyzes the legal nature of the monetary irregular-deposit contract, considering the main characteristics regarding the loan contract or mutuum. Also, this chapter will examine the juridical logic of both institutions, and how the general legal principles were discovered from classical Roman law. Chapter 2 tries to analyze the history of economic thought and, in particular, the historical process on the violation of general legal principles in relation to the monetary irregular-deposit contract. Finally, chapter 3 studies the various doctrinal attempts to develop a new type of monetary irregular-deposit contract, with the sole purpose of legitimizing a banking system under a fractional-reserve coefficient.
